At Bagner Law, we understand that divorce is never easy—especially when delays in finalizing the process impact your ability to move forward. For some of our clients in Hayward and surrounding areas, a bifurcated divorce offers a smart legal solution. This approach allows you to terminate your marital status before resolving all other issues, helping you regain clarity and independence while continuing to work through more complex matters like property division, custody, or support.

Our legal team helps you understand whether bifurcation is right for your situation, walks you through the steps involved, and represents your interests throughout the process. Whether you’re facing a high-conflict divorce or just need a faster way to move forward, we’re here to help you protect your future—one step at a time.

What is a bifurcated divorce?

A bifurcated divorce allows a couple to legally end their marriage (marital status) before resolving other divorce-related issues such as asset division, spousal support, child custody, or debts. In California, courts may approve a bifurcation request to help one or both parties move forward with their lives, even while legal proceedings on remaining matters are ongoing.

Why would someone choose a bifurcated divorce?

There are several reasons why someone might want to end their marital status early:

  • One or both spouses want to remarry.
  • The emotional or psychological burden of remaining legally married is too great.
  • Prolonged negotiations or litigation over property, support, or custody are delaying closure.
  • There’s a need to separate financial or insurance matters quickly.

A bifurcation can help relieve stress, speed up certain legal or personal changes, and give each party room to heal and plan for the next chapter.

Is bifurcation available to everyone in California?

In general, yes—but it must be requested and approved by the court. California family courts allow bifurcation under Family Code §2337, but there are conditions. You’ll need to file a formal request and meet certain legal requirements, such as sharing preliminary financial disclosures. We can help you prepare and file the request correctly to maximize your chance of approval.

Will a bifurcation affect my ability to resolve other divorce issues?

Not at all. It can make things more manageable by separating the emotional from the financial. Ending the marriage formally may reduce tensions and help both parties focus on the remaining legal issues with more clarity. That said, some protections—like maintaining insurance coverage or pension rights—may need to be addressed in advance. We’ll help ensure everything is considered before moving forward.
